The staff of the online store Obrt Tesu, owned by Suzana Šop-Tovilović guarantee that you will receive top-quality service and obtain maximum value for your money. If you are not satisfied with the delivered product(s), you may return them within 14 calendar days and we will refund you in full.

1. GENERAL PROVISIONS

1.1 These General Terms and Conditions for the use of the website and the use of the Webshop service (“General Terms”) govern the use of the website by users and the use of the Webshop service.

1.2 In these General Terms, terms written in bold have the following meaning:

Registered User means any fully legally capable person, legal or natural, who has registered to use the Webshop service on the Website(s) and has residence and/or registered office in the Republic of Croatia.

Webshop service is a service enabling Registered Users to purchase products of Obrt Tesu, owned by Suzana Šop-Tovilović through the Website(s).

1.3 By accessing the Website(s) through an appropriate technical means and using them, each User undertakes to comply with these General Terms and agrees that the provisions of these General Terms apply to them.

 

 

2. RESTRICTIONS OF USE AND LIMITATION OF LIABILITY

2.1 The User undertakes not to:

2.2 Documents, data and information published on the Website(s) may not be reproduced, distributed, or otherwise used for commercial purposes without the express consent of Obrt Tesu, owned by Suzana Šop-Tovilović, nor in any manner that may cause damage to Obrt Tesu, owned by Suzana Šop-Tovilović or any third party. Documents, data and information published on these Website(s) may be used solely for the individual needs of Users, with full respect for all copyright and proprietary rights and the rights of third parties.

2.3 By using the content of these Website(s), the User accepts (i) all risks arising from the use of the Website(s) and accepts (ii) to use the content of the Website(s) exclusively for personal use and at their own responsibility.

2.4 Obrt Tesu, owned by Suzana Šop-Tovilović fully disclaims any liability (i) that may arise in any manner from, or be in any manner connected with, the use of the Website(s), (ii) for any actions of Users by use or misuse of the content of the Website(s), and (iii) for any damage that may occur to the User or any third party in connection with the use or misuse of the Website(s) content.

2.5 The Website(s) also contain documents, data, information and links (“links”) to other Internet pages created by third parties, which will, to the extent necessary and possible, be marked as such. Obrt Tesu, owned by Suzana Šop-Tovilović has no control over such documents, data, information or other Internet pages and fully disclaims any liability, including but not limited to the accuracy, completeness and availability of content on third-party Internet pages. 2.6 Obrt Tesu, owned by Suzana Šop-Tovilović reserves the right to amend the content of the Website(s), to discontinue the Website(s), and to restrict access to the Website(s), all without prior notice, and shall not be liable for any consequences resulting from such amendments, discontinuation or restriction.

2.7 Obrt Tesu, owned by Suzana Šop-Tovilović shall not be liable for any consequences resulting from the unavailability of the Website(s) due to any technical reasons.

2.8 Obrt Tesu, owned by Suzana Šop-Tovilović reserves the right to change the prices of its products.

3. INTELLECTUAL PROPERTY

3.2 By using the Website(s), the User is granted a limited, non-exclusive, non-transferable and revocable licence to use the content of the Website(s) solely by viewing it for personal purposes.

5. USE OF THE WEBSHOP SERVICE AND USER REGISTRATION

5.1 The use of the Webshop service is available exclusively to Registered Users who are of legal age and fully legally capable, which they confirm by using the Webshop service.

5.2 User registration is carried out via the Website(s), during which the User will be required to enter certain personal data and consent to the use of such personal data.

5.3 After successful registration, the Registered User receives a username and password used for authorization for using the Webshop service. The Registered User must keep the username and password confidential. If the User suspects unauthorised use of their username and/or password, they are responsible for all possible costs caused by the use of their username and/or password until the moment they notify Obrt Tesu, owned by Suzana Šop-Tovilović through the contacts published on the Website of the suspected unauthorised use. The User is also responsible for all unauthorised activities authorised and performed under their username and/or password.

5.4 By registering, the User confirms:

5.5 The Registered User agrees that purchases through the Webshop service are made by the Registered User purchasing products available through the Webshop service (“Products”) by selecting them based on the image and basic product description. Product images are for illustrative purposes only and may not always correspond in all details to the products actually available. Due to the possibility of individual monitor settings, differences in human colour perception, etc., Obrt Tesu, owned by Suzana Šop-Tovilović does not guarantee full conformity of product colours with the colours as seen by the Registered User on their monitor.

5.6 Product ordering is carried out electronically. By clicking on the “Buy” icon, the selected product is stored in the shopping cart. To continue the procedure, it is necessary to click “CART”, where all selected items are displayed. Goods shall be deemed ordered at the moment the customer completes the entire ordering process. You will receive confirmation at the email address used to register as a customer that the order has been received by Obrt Tesu, owned by Suzana Šop-Tovilović.

5.7 If Obrt Tesu, owned by Suzana Šop-Tovilović is unable to deliver any of the ordered products, it will contact the customer by phone or email and inform them accordingly. The customer has the option to cancel the ordered product or request a replacement product.

5.8 Pursuant to Article 10 of the Consumer Protection Act (ZZP), the online shop tesu.hr enables you to submit written complaints regarding online purchases to our email address info@tesu.hr.

5.9 Upon registration, each User has the option to subscribe to our newsletter.

If you are not a Registered User/customer but still wish to receive our notifications, you may subscribe to our newsletter located in the bottom right corner of the homepage.

6. PRODUCT PRICES

6.1 Obrt Tesu, owned by Suzana Šop-Tovilović may grant certain discounts for purchases via the webshop, which may apply to a certain time period; however, such discounts shall not apply to clearly marked items and products in the “Sale Items” category.

6.2 Product prices are subject to change until the purchase is confirmed.

6.3 By confirming the purchase, Registered Users complete the purchase process via the Webshop service. The sales contract is concluded at the moment payment is received.

6.4 The shipping cost for purchased products is not included in the product price.

Shipping costs are not included in the product price and will be calculated at checkout depending on the delivery destination and selected shipping method.

Free shipping is available for orders that meet the minimum value thresholds specified on the Shipping page.

 

7. METHODS OF PAYMENT FOR PRODUCTS VIA THE WEBSHOP SERVICE

7.1 Users may pay for products in the following ways, with the selection made on the Website(s):

All payments are processed securely via certified third-party payment providers.


7.2 Only after the successful transfer of funds to the bank account of Obrt Tesu, owned by Suzana Šop-Tovilović may the Registered User expect the agreed delivery of products purchased via the Webshop service.

 

 

8. DELIVERY VIA THE WEBSHOP SERVICE

1.1 Delivery

Delivery of products is available worldwide.

8.2 After Obrt Tesu, owned by Suzana Šop-Tovilović records the order (no later than 48 hours after the product order is placed by the Registered User - applicable only if such period expires during a working day in the Republic of Croatia and not applicable to non-working days), products shall be delivered to the Registered User within:

  • Republic of Croatia: up to 2 business days

  • Europe: 3 to 5 business days

  • Rest of the world: approximately 10 business days

8.3 If for any reason the User was not available via the contact number provided, Obrt Tesu, owned by Suzana Šop-Tovilović shall not be responsible for the extension of the above delivery deadlines.

8.4 The order will be delivered to the delivery address stated during the registration of the user account, and if the User is not at the delivery address:

  • the GLS delivery service will attempt delivery on the next business day;

  • the products may be collected by another person (an adult household member or a person authorised by the Registered User) upon presentation of a personal identification document, and, if cash on delivery has been agreed, after payment to the delivery service.

The order will be delivered to the delivery address provided by the User during checkout.

If the User is not available at the time of delivery:

  • the courier service may attempt redelivery in accordance with their delivery policy;

  • the package may be delivered to another person at the address (e.g. an adult household member) or a person authorised by the User, upon presentation of a valid identification document;

  • the courier service may leave a notice with instructions for redelivery or collection at a designated pickup point.

Delivery is carried out by third-party courier services (such as GLS, Hrvatska pošta, or international carriers), depending on the destination.

The seller is not responsible for delays caused by the courier service, customs procedures, or other circumstances beyond the seller’s control.


8.5 Upon receipt of the shipment, the User must inspect the shipment, report visible damage directly to the delivery person, and refuse to accept a damaged shipment. By signing the delivery note and receiving the invoice, the Registered User confirms that they inspected the product upon receipt.

If the Registered User refuses to accept the shipment due to identified and visible damage to the transport packaging, they are obliged to complete the appropriate delivery service form and notify Obrt Tesu, owned by Suzana Šop-Tovilović by email or telephone using the customer instructions on the webshop pages, stating whether they want re-delivery or a refund. Upon receipt of the complained shipment and the appropriate form, Obrt Tesu, owned by Suzana Šop-Tovilović undertakes within the next 15 business days to perform re-delivery if the products are in stock, and if the same product must be ordered from a supplier, the deadline shall be extended by the supplier’s delivery period, without additional costs to the User, or to refund the money, in accordance with the Registered User’s request.

8.6 If the Registered User does not collect the product or refuses to collect the product without a valid reason, Obrt Tesu, owned by Suzana Šop-Tovilović reserves the right to claim compensation for incurred costs.

 

 

9. TERMINATION (WITHDRAWAL) AND RETURN OF PRODUCTS PURCHASED VIA THE WEBSHOP SERVICE

9.1 The Registered User has the right to terminate the contract within 14 calendar days from the date of delivery of the product, to lodge a complaint regarding the purchased product or to return the product with a full refund if, upon receipt of the goods, they notice defects in the products or the delivered products are faulty, without stating reasons. Based on the request for a refund or replacement, Obrt Tesu, owned by Suzana Šop-Tovilović will refund the funds in full to the account specified by the Registered User in the request, or replace the product with a new one, within thirty (30) days from the date of receipt of the returned product at the address specified in the complaint form.

9.2 In order to exercise the right to unilateral termination of this Contract, you must inform us of your decision to unilaterally terminate the contract before the expiry of the deadline, by an unambiguous statement sent by post or email, stating your first and last name, address, telephone number, fax number or email address. The deadline for unilateral termination is 14 days from the date of conclusion of the contract.

If you unilaterally terminate this Contract, we will refund the money we received from you, including delivery costs, without undue delay, and no later than within 14 days from the day we received your decision to unilaterally terminate the contract, unless you chose a type of delivery other than the cheapest standard delivery offered by us.

The refund will be made using the same means of payment you used for the transaction. If you agree to another method of refund, you will not incur any costs in relation to the refund.

We may issue the refund only after the goods have been returned to us or after you provide evidence that you have sent the goods back to the previously confirmed address.

The Registered User announces the return of purchased products via email to info@tesu.hr, after accessing the Webshop service using their username and password, by entering personal data and other purchase-related data.

9.3 The return of delivered products is made by delivery to the address of which the Registered User is informed on the complaint form.

9.4 The costs of returning the products are borne exclusively by the Registered User.

9.5 The Registered User is obliged to return the delivered products in the condition in which they were delivered and in the original packaging (the commercial packaging in which the goods were delivered). Return the goods or hand them to us without undue delay, and in any event no later than within 14 days from the day you notified us of your decision to unilaterally terminate the contract. You are liable for any diminished value of the goods resulting from handling of the goods, other than what was necessary to establish the nature, characteristics and functioning of the goods.

9.6 If it is unequivocally determined that the complaint is unjustified or that the defect of the ordered product arose due to inadequate handling or use, Obrt Tesu, owned by Suzana Šop-Tovilović is not obliged to refund the money or deliver a replacement product. The complained product will be returned to the User at the User’s expense, with a written explanation of the reasons for rejecting the refund or replacement request.

9.7 If the refund or replacement request is justified, Obrt Tesu, owned by Suzana Šop-Tovilović will act as stated in Clause 9.1, whereby the cost of re-sending the product shall be borne by Obrt Tesu, owned by Suzana Šop-Tovilović.

9.8 If an error occurred during packing and the customer did not receive the ordered product but another product, they must report this via the complaint form within eight (8) days. In such case, the User returns the incorrectly delivered product at the expense of Obrt Tesu, owned by Suzana Šop-Tovilović, which undertakes to deliver the ordered product or refund the money (in accordance with the User’s request) within fifteen (15) days of receipt of the incorrectly delivered item.

9.9 If the User did not receive the ordered and paid product, they must report this within eight (8) calendar days from the expected arrival date of the ordered product via the complaint form or via the contacts published on the Website. Within that period, Obrt Tesu, owned by Suzana Šop-Tovilović must determine what happened to the complained shipment and inform the User of further complaint resolution.

9.10 The Seller reserves the right to terminate the concluded contract if it concludes that the contract was concluded in an unethical manner, i.e., where it is concluded that damage was caused to the seller or a third party, including: using discount codes for which the end customer is not authorised or which were not obtained legally and properly; using payment instruments to which the customer has no right (stolen or misappropriated credit cards, current or giro account cards, etc.); and other methods of fraud. In such termination, the Seller is obliged to inform the customer in writing in a simple and unambiguous manner of the cancellation of the contract and to refund the funds in full if an advance payment method was used.

 

 

10. OTHER TERMS OF THE WEBSHOP SERVICE

10.1 Obrt Tesu, owned by Suzana Šop-Tovilović shall not be liable for any damage that may occur to the Registered User or third parties:

  • due to unauthorised use of the username and password or connected with such use;

  • in connection with the use or misuse of the Webshop service, if the damage did not arise through the fault of Obrt Tesu, owned by Suzana Šop-Tovilović.

10.2 Obrt Tesu, owned by Suzana Šop-Tovilović shall not be liable for any damage that might occur due to interruption of the Internet connection when using the Webshop service.

10.3 The use of the Webshop service shall be governed by the provisions of the applicable Electronic Commerce Act and other laws relating to the provision and use of the Webshop service.

 

 

11. AMENDMENTS TO THE GENERAL TERMS AND OTHER PROVISIONS

11.1 Obrt Tesu, owned by Suzana Šop-Tovilović reserves the right to amend these General Terms without prior notice. Registered Users are obliged, each time they use the Website(s), and especially the Webshop service, to check the applicable General Terms. The applicable General Terms will be published on the Website(s).

11.2 For the use of the Webshop service, the General Terms in force at the time of receipt of the price for the ordered product shall apply.

11.3 Any disputes that may arise on the basis of these General Terms shall be resolved before the competent court in Zagreb.

Documents published on this Website may be copied only for non-commercial purposes and only for individual use, with respect for all copyrights, other proprietary rights, and any stated limitations of rights.

 

 

12. PAYMENT SECURITY

12.1 The confidentiality of customer data is protected and ensured by the use of SSL encryption.
